Terms of Service

These terms are an agreement between you and MyAcademia (“we”, “us”) for using the MyAcademia platform at myacademia.app, the academy websites it hosts, and the services that come with them (together, the “Service”). By creating an account, creating an academy or using the Service, you agree to these terms and to our Privacy Policy.

MyAcademia is in beta. The Service works and is used to sell real courses, but features will change, and you may meet bugs. We will tell academy owners about changes that significantly affect them before they happen, where we reasonably can.

People use MyAcademia in two ways:

• Academy owners (and the staff they invite) create an academy, publish courses, set their own prices and sell to their own students.
• Learners join an academy and take its courses.

Each academy is run by its owner, not by us. The owner decides what is taught, what it costs, who can join and what their refund policy is, and each academy has its own terms and privacy policy on its own website. When a learner buys a course, the purchase is between the learner and that academy. We provide the software and process the payment through Stripe on the academy’s behalf.

One MyAcademia account works at every academy you join. Give us accurate details, keep your sign-in secure, and tell us straight away at support@myacademia.app if you think someone else has used your account. You are responsible for what happens under your account.

You must be at least 18 to create an academy. Learners under 18 may use the Service only with the involvement of a parent or guardian, and only where the academy allows it.

An academy can be on one of these plans:

• Free: one course, with a 5% platform fee on student payments.
• Starter: A$49 or US$35 per month, with a 3% platform fee on student payments.
• Pro: A$99 or US$70 per month, with a 2% platform fee on student payments.
• Business: A$199 or US$140 per month, with a 1% platform fee on student payments.

Paid plans are billed monthly in advance through Stripe and renew automatically until you cancel. You can cancel at any time from your plan and billing page; your plan stays active until the end of the period you have paid for, and then your academy moves to the Free plan. We do not refund part of a billing period, except where the law requires it.

We may change plan prices or features. We will give you at least 30 days’ notice by email before a price increase applies to you, and you can cancel before it does.

AI credit you buy is prepaid, is used against your academy’s AI usage, and is taken back in proportion if the payment is refunded or disputed.

To sell courses, an academy owner connects their own Stripe account. Students pay the academy directly through Stripe, and the money settles to the owner’s bank account on Stripe’s schedule. By connecting, you also agree to Stripe’s own terms, including the Stripe Connected Account Agreement.

Our platform fee (the percentage for your plan, above) is deducted automatically from each student payment. Stripe’s own processing fees are separate and are charged to you by Stripe.

As the seller of your courses, you are responsible for:

• your prices, your refund policy, and handling refunds, disputes and chargebacks;
• any GST or other tax on your sales, and your own tax reporting;
• your obligations to your students under the Australian Consumer Law and any other law that applies to you.

Your academy is found at its own address. We do not contact your students to promote other academies or our own products. We do not currently run a marketplace or public directory of academies.

If we run a marketplace where students can find academies:

• joining it is your choice, and your academy is not listed unless you turn listing on;
• you can leave it at any time;
• sales to students who find your academy through the marketplace may carry a separate, higher platform fee, which we will tell you before you join;
• students who reach your academy any other way are charged your plan’s platform fee only.

You own what you create and upload: courses, lessons, videos, files, messages and submissions. You give us a licence to host, store, copy, display and process that content only as needed to run the Service for you and the people you share it with. The licence ends when the content is deleted, except for copies we must keep by law or that remain for a short time in backups.

You confirm you have the rights to everything you upload, and that it does not break anyone else’s rights or the law. We may remove content, or restrict access to it, if we reasonably believe it breaks these terms or the law.

Some features use AI to draft course outlines, lessons and quizzes. AI output can be wrong, incomplete or similar to existing material. It is always saved as a draft, and an academy owner must review it and choose to publish it. You are responsible for anything you publish, including AI-assisted content.

You must not use the Service to:

• break the law, or publish content that is illegal, infringing, misleading, hateful or harmful;
• send spam, or harass or abuse other people;
• try to access another academy’s or person’s data, get around security or usage limits, or probe, scan or overload the Service;
• copy, scrape or resell the Service or other people’s courses without permission;
• sell anything you are not allowed to sell, or anything Stripe prohibits.

Courses are provided by the academy that sells them. Questions about a course, its content or a refund go to that academy first; its contact details are on its website. If you cannot resolve something with an academy, contact us at support@myacademia.app and we will help where we can.

Nothing in these terms limits your rights as a consumer under the Australian Consumer Law.

You can stop using the Service at any time, and academy owners can cancel their plan at any time. We may suspend or close an account or academy if it breaks these terms, if a payment fails and is not fixed, or if we must to protect people or comply with the law. Where it is reasonable, we will tell you first and give you a chance to fix the problem.

If your academy is closed, you can ask us within 30 days for a copy of your course content and your student list, and we will provide one where it is reasonably practicable.

Some rights under the Australian Consumer Law cannot be excluded, and nothing in these terms excludes them. Beyond those rights, and to the extent the law allows:

• the Service is provided as it is, without other promises about availability or fitness for a particular purpose;
• we are not responsible for indirect or consequential loss, including lost profits or lost data;
• our total liability to an academy owner is limited to the fees you paid us in the 12 months before the claim, and our liability for a failure to meet a consumer guarantee is limited to supplying the service again or paying for it to be supplied again.

We may update these terms. When a change is significant, we will tell academy owners by email at least 14 days before it applies. The date at the top of this page shows the latest version. If you keep using the Service after a change applies, the new terms apply to you.

These terms are governed by the laws of New South Wales, Australia. You and we agree to the non-exclusive jurisdiction of its courts.
